Preserve Family WealthÂAt SI Elder Law we strive to preserve family wealth, if not for this generation, then the next. SI Elder Law works with families to find different payor sources to pay for long term care, rather than an elder's bank account. SI Elder Law works with VA and Medicaid laws to make sure that our clients are receiving the most benefits possible.  Long term care costs include: care at home, assisted living care, and nursing home care. Even if you have long term care insurance, you still need Elder Law Planning to cover the costs when your long term care insurance runs out. In most instances, SI Elder Law is able to save at least half of your assets. This means that you will be able to leave a legacy to your family instead of giving it to the nursing home or caregivers.   In addition to Medicaid Planning and VA Aid and Attendance Planning, SI Elder Law also provides:  Estate PlanningThe process whereby a person creates legal documents that outline the disposition of personal and real property upon death. The most common legal tools used are the Last Will and Testament and a Living Trust. The specific documents that are necessary depend upon your specific situation.
 Estate Administration/ ProbateEstate Administration is called Probate in Illinois and is the legal process of going through the court system to distribute property upon death. Although hiring an attorney is not necessary for all estate administration situations, a consultation with an attorney may be helpful to determine if estate administration is necessary, and to explain how to smoothly go through the process.  Tax Avoidance PlanningThe IRS sets out rules that must be followed in order to avoid paying a death tax. Just like Medicaid and VA laws, Tax Avoidance Planning is set out in statutes about the steps that must be taken to avoid any death tax. SI Elder Law knows those rules and regulations and will set up a plan for your tax avoidance. This is often important for farmers who are land rich and cash poor. |
